This Privacy Policy (the “Policy”) describes the policies and practices of ReBokeh Vision Technologies Inc. (“ReBokeh” or “we”) regarding the use, disclosure and maintenance of information we collect from you through our website and our mobile application (collectively, the “Sites”).  Please read this entire Policy before using or submitting information to any of the Sites.  By using any of the Sites, you are deemed to agree to the terms of this Policy, so please do not use any of the Sites if you do not agree with these terms.

We may update this Policy at any time.  Any changes to the Policy will become effective upon the date of our posting of the revised Policy on the Sites.  If you visit any of the Sites following the effective date of the revised Policy, you will be deemed to have accepted the Policy’s updated terms.

  1. What Types of Information Does ReBokeh Collect Through the Sites?

The information we collect through the Sites includes “Personally Identifiable Information” (or “PII”), which is information that identifies you as an individual.  Like many websites, our Sites actively collect information from its visitors both by asking you specific questions when you create a profile and by permitting you to communicate directly with us via e-mail. Some of the information that you submit may be PII, such as your full name, date of birth, e-mail address, user name, information about your vision, billing address, username and password, etc.  Certain areas of the Sites may require you to submit information in order to make a purchase or to receive information from us in the future (such as e-mail alerts for news releases).  We do not store any credit card information you may submit.

The Sites also automatically collect information about you that is generally not PII (“Non-PII”) but relates to your use of the Sites.  Non-PII is aggregated information, demographic information and any other information that does not reveal your specific identity.  Non-PII is “passively” collected from you through browser navigational tools, such as cookies, coarse geolocation, pixel tags, “log files,” “server logs,” and “clickstream data.”  ReBokeh’s mobile application asks for permission to track your location, which information allows us to improve your experience and better understand the general locations of our users across the globe.  Cookies are small data files that a website stores on the hard drive of the device through which a website user connects to the website.  You can set your browser to accept all cookies, to reject all cookies, or to notify you whenever a cookie is offered so that you can decide each time whether to accept it.  However, refusing a cookie may in some cases preclude you from using, or negatively affect the display or function of, a Site or certain areas or features of a Site.  To learn more about cookies, please visit http://www.allaboutcookies.org.

These types of technologies enable the Sites to compile statistics about our daily number of Site visitors or specific page requests, and to identify a webpage you may have visited before visiting a Site. ReBokeh may collect statistics about the behavior of visitors to its websites. For instance, ReBokeh may use third-party scripts to collect site behavior and analytics. ReBokeh may display this information publicly or provide it to others.

[The Sites currently do not respond to a “Do Not Track” browser signal from a user.]

By using any of the Sites, you are deemed to unambiguously agree to its use of any cookies that you do not disable.

  1. How Does ReBokeh Use the Information It Collects?
    1. PII. We may use the PII that we collect about you for any or all of the following purposes:
      1. Responding to Requests. To respond to your requests, such as to answer your questions sent through the “Contact Us” form on the Sites.
      2. Communications with You. If you join our mailing list or otherwise provide your contact information to us, we may send you newsletters or other notices to inform you of information relevant to our products, programs, or services that we believe may be of interest to you.  You may opt out of receiving any of our commercial communications, as described in those communications.
      3. ReBokeh Business Purposes. We use PII about you for ReBokeh’s business purposes, such as to help us improve the Sites, including by requesting feedback, and for related internal purposes such as data analysis, audits, enhancing the Sites, and identifying usage trends.
    2. Other Information. We use non-PII to help us improve the Sites, such as by analyzing Site visitor trends, including usage of certain pages or functions on the Sites.  We may also use non-PII for other purposes, but if any such use involved combining the non-PII with any data so that it became identifiable to you or another person, we would then treat it as PII in accordance with this Policy.

III.        With Whom Does ReBokeh Share PII Collected Through the Sites?

A.  Third Party Service Providers.  We share PII with unaffiliated third parties who provide us with services, such as the designer of the Site and others who assist us with technology, email services, data analysis, or similar services.  We do not share PII with unaffiliated third parties for their own marketing purposes.

B. Entities Entitled Under Law . We may disclose PII as we believe to be appropriate in the following circumstances: (i) when required by applicable law, including laws outside your country of residence; (ii) to comply with legal process (iii) to respond to requests from public and government authorities; (iv) to enforce the terms and conditions for use of the Sites, including this Policy; (v) to protect and defend our rights and property; (vi) to protect ReBokeh’s interests or the interests of others; and (vii) to permit us to pursue available remedies or limit the damages that we may sustain.  We have no obligation to notify you of such disclosures, except as required by applicable law.

C. Acquirers or Assignees. If ReBokeh or substantially all of its assets were acquired, user information would be one of the assets that is transferred or acquired by a third party.  By using our Sites, you acknowledge that such transfers may occur, and that any acquirer of ReBokeh may continue to use your personal information as set forth in this policy.

  • How Can You Manage PII We Maintain?

To keep your personally identifiable information accurate, current, and complete, please contact us as specified in Section VIII below. You will be able to self-update your personal information within your user profile. We will take reasonable steps to update or correct personally identifiable information in our possession that you have previously submitted via the Sites. Please note that we are not responsible for correcting, updating or deleting any information in the databases of third parties.

  1. How Does ReBokeh Protect and Maintain PII Collected Through the Sites?
    1. We will take reasonable steps to protect your personally identifiable information as you transmit it from your computer to our Sites and to protect it from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should be aware that no Internet transmission is ever fully secure or error-free.  Where you use passwords or other special access features on the Sites, it is your responsibility to safeguard them from disclosure or misuse.
    2. Data Retention. We will retain PII about you for the period necessary to fulfill the purposes outlined in this Policy.
  2. Collection of PII by Others
    1. Other Websites. The Sites may contain links to websites operated by parties not affiliated with ReBokeh.  These linked sites are not under ReBokeh’s control and we are not responsible for the privacy practices or the contents of any such unaffiliated parties or their websites. If you provide PII through any such third-party website, the PII will be collected by, and controlled by the privacy policy of, that third party.  We recommend that you familiarize yourself with the privacy policies and practices of any such third parties, which are not governed by this Policy.
    2. Through Our Sites. We allow third parties such as Google to use cookies or other technologies to collect information about Site visitors in order to provide analytics and other services based on a user’s visits to sites across the Internet and across other mobile applications.
  3. Use of the Site by Children. None of the Sites is directed to children under the age of thirteen (13), and we do not knowingly collect PII from any children under age 13.  If we discover that we have collected PII from a child under age 13, we will delete it. 
  • International Transfers of Information. By using the Sites, you are deemed to understand and unambiguously consent to the collection and processing of your PII in the United States, with the awareness that the laws of the United States may not provide as much protection for PII as the laws of certain other countries or territories.
